Vira

The Netherlands Association for Computer Lawyers (VIRA) was established on 24 February 1995 by a group of lawyers to further the expertise of lawyers pursuing their profession in the field of computer law. VIRA is a specialist association recognised by the Netherlands Bar Association.

VIRA furthers the expertise of lawyers pursuing their profession in the field of computer law by imposing requirements on the education, and continuing education, of its full and applicant members and on the degree to which these members are actually involved with ICT issues on a practical level.

Together with the Grotius Academie, VIRA organises the post-degree specialist programme in Computer Law and the annual follow-up day for this programme. Legal professionals who are unable to or who do not wish to join VIRA may also take this programme and attend the follow-up days.

In addition, two meetings are organised annually for VIRA members (full and applicant) at which the legal and the practical aspects of current developments dominate alternately. VIRA also invites representatives of disciplines other than members of the Bar to these meetings. Contacts with representatives of other disciplines are indispensable to the provision of a professional service and for creating legal solutions to ICT issues which are also of value to the client outside the strictly legal environment.

De VIRA-advocaat

Het (aspirant-)lidmaatschap van VIRA staat open voor advocaten die de intensieve post-doctorale specialisatieopleiding Informaticarecht van de Grotius Academie hebben voltooid. Daarnaast worden er door VIRA eisen gesteld aan de opgedane praktijkervaring, de mate waarin informaticarecht in de praktijk wordt beoefend en de permanente opleiding van de (aspirant-)leden.

Specialist zijn in het informaticarecht betekent voor een VIRA-advocaat: kennis en begrip van de informatica- en telecommunicatiepraktijk en van de technische en praktische omgeving waarin de vragen van cliënten zich afspelen, en het voortdurend actualiseren van de onmisbare kennis en know-how op de (vaak in snel tempo veranderende) regelgeving en de juridische ontwikkelingen op dit gebied.

De (aspirant-)leden van VIRA wisselen regelmatig kennis en ervaring uit: niet alleen binnen de advocatuur, maar ook door overleg met vertegenwoordigers van rechterlijke instanties en deskundigen op het gebied van ICT. Zo zijn zij steeds van de laatste ontwikkelingen op de hoogte.

De (aspirant-)leden van VIRA kunnen behulpzaam zijn op de volgende terreinen:
Internet, electronic commerce, inrichting en beheer van websites, bescherming persoonsgegevens, beveiliging, aansprakelijkheid van providers (content, access, service), turn-key overeenkomsten, (aansprakelijkheid mislukte) automatiseringsprojecten, softwarelicenties en algemene (licentie-) voorwaarden, facilities management en outsourcing, source code escrow, bescherming van software, domeinnamen, databanken, telecommunicatie (contracten, regelgeving), joint ventures en samenwerkingen in de ICT-sector, tenders (aanbestedingen), distributierelaties, informatietechnologie, R&D (ontwikkelings-) overeenkomsten, geheimhoudingsovereenkomsten, computercriminaliteit, voorkoming en begeleiding van geschillen, gerechtelijke procedures, arbitrage en mediation.
